The regulations of the Eternia Club

  1. The regulations of the Eternia Club, hereinafter referred to as the club, define the rights and obligations of the parties to the membership contract.
  2. The Eternia Club provides sports and recreational services which may be used by adults and persons under 18 years of age.
  3. An under-ages must have the consent of a parent or legal guardian to participate in sports activities at the club.
  4. Prior to signing a contract with the Club, the Club Member must familiarise themselves with these rules, which are attached to the Membership Contract.
  5. There is a fee for taking part in activities organised by the Club, using the Club equipment and conducting individual training in the Club area in accordance with the current price list.
  6. Membership fees may be paid in the following forms: by cash, credit or debit card at the Club reception or by bank transfer to an account.
  7. Participation in activities as well as access to the Club premises is only possible after signing the Membership Agreement or paying a fee for one-time participation in activities.
  8. Every adult Club Member has a profile on the WodGuru portal, which is created by the Club upon signing the Agreement.
  9. A new Club Member is required to attend a one-month introductory Start-Up course. The availability of a full schedule of classes is decided by the trainer.
  10. On statutory holidays (e.g. public and church holidays, Sundays etc.) the Club may be closed or not run organised classes.
  11. The Club has the right to impose the need for limited places on group classes in the event of attendance exceeding the capacity of the class.
  12. Reservations for classes are made through the portal, by telephone or by electronic communication. Enrolment in classes is confirmed each time: in the case of the portal by information in the programme, in the case of other forms by information from the Club staff.
  13. In the case of booking a place in a class the Club Member undertakes to cancel his/her booking before 1 hour before the start of the class. In the event of non- cancellation of a booking and absence from a class the Club may charge the Club Member a fee of 20PLN.
  14. The Club reserves the right to cancel classes in an emergency. In such an event the Club will inform Members via information on the portal, on the Club’s Facebook profile. In such an event the Club Member has no claims against the Club.
  15. The Club may refuse to allow a Club Member to participate in activities in the event of: A) being late for a class; B) being in a state indicating the consumption of alcohol or intoxicants; C) when the Club Member’s health condition, in the opinion of the trainer in charge of the class, does not allow him/her to participate in the class; D) when the number of people participating in the class exceeds the ability to conduct the class effectively and the Club Member has not booked a place in advance.
  16. The Club Member is obliged to be clean, not to disturb the peace and order in the Club within the framework of generally accepted standards of behaviour, and not to disturb other persons using the Club services.
  17. The Club Member is required to wear sports attire and changeable sports shoes while on the Club premises.
  18. Personal items, clothing and other belongings of the Club Member should be kept by the Club Member in a locker to which he is given a key.
  19. The Club is not responsible for valuables left in the locker or on the Club premises.
  20. In the event of damage to Club belongings by a Club Member, the Club Member will be held fully responsible both legally and financially.
  21. Prior to commencement of training, the Club Member should obtain confirmation of his/her health status to determine if there are any contraindications to high intensity training. The Club Member should notify the trainer in charge of the class of any health condition that may affect the performance of the training.
  22. The Club Member uses the services of the Club at his/her own risk. The Club Member is not entitled to make any claim against the Club for injury or loss of health.
  23. In the case of sports activities for underage Club Members, the Club is responsible for their safety only on the Club premises for the duration of the activity.
  24. The parent is obliged to bring and collect the minor from sports activities.
  25. The Club Member is solely responsible for damage to a third party caused by his/her failure to comply with the provisions of these Rules and Regulations, instructions and directions of instructors and other Club staff.
  26. The Membership Agreement may be terminated by either party with one month’s notice. The notice period is counted from the end of the current term. The Club Member is obliged to pay all membership fees for the notice period. Notice of termination should be given in writing.
  27. The Club may terminate the Membership Agreement without notice in the event of: A) the Club Member is in breach of the Terms and Conditions; B) the Club is suspended or ceases to operate; C) the Club Member is in breach of public order and the rules of social intercourse; D) the Club Member acts to the detriment of the Club; E) the Club Member fails to pay the monthly fee for 3 terms.
  28. In the event that the Club suspends or ceases operations, it will refund the Club Member’s membership fees for the unused period on the understanding that the pass is valid for 30 days.
  29. The staff and instructors shall monitor compliance with the rules and regulations. Any complaints should be submitted directly to the Club management.
  30. In other situations, not covered by these Rules and Regulations, the provisions of the Civil Code shall apply. These Rules and Regulations and the Agreement and any disputes arising from them shall be governed by Polish law, and the court competent to resolve disputes shall be the District Court for Wrocław-Fabryczna.
